um hey guys i would like to say this...
those who know me personally know that one of my dreams is to become a mangaka!!
that Tokyo pop was going to be my start~!
well one day decided to read the contract, there went my dream with Tokyo pop.
disclaimer
i don't suggest this deal to anyone that doesn't have a income of their own, have a lawyer or have parents who have the those~!
I'm going to go to places which pissed me off!
MORAL RIGHTS AND YOUR CREDIT
Moral rights is a fancy term (the French thought it up) that basically has to do with having your name attached to your creation (your credit!) and the right to approve or disapprove certain changes to your creation. Of course, we want you to get credit for your creation, and we want to work with you in case there are changes, but we want to do so under the terms in this pact instead of under fancy French idea. So, in order for us to adapt the Manga Pilot for different media, and to determine how we should include your credit in tough situations, you agree to give up any "moral rights" you might have.
Of course, you still have your rights under this pact to your credit."
First things first, Don't bash the french, their food is good and they got style.
secondly here is the facts on moral rights
(vis Wiki and other sites)
"Moral rights are rights of creators of copyrighted works generally recognized in civil law jurisdictions and, to a lesser extent, in some common law jurisdictions. They include the right of attribution, the right to have a work published anonymously or pseudonymously, and the right to the integrity of the work. The preserving of the integrity of the work bars the work from alteration, distortion, or mutilation. Anything else that may detract from the artist's relationship with the work even after it leaves the artist's possession or ownership may bring these moral rights into play. Moral rights are distinct from any economic rights tied to copyrights. Even if an artist has assigned his or her rights to a work to a third party, he or she still maintains the moral rights to the work."
in simple words
KISS YOUR STORY PLOT GOODBYE!!
oh well will work with you otherwise meaning if you don't agree you don't get published!
So we can basically take your name off your baby and change it the way we want it.
and the reason for you take my moral rights is?
.we want to give you credit for your baby, bullshit, you took away our moral rights!!
so what happens when you send it in?
"OUR APPROVAL AND THE EXCLUSIVITY PERIOD
If we havent given you a thumbs up our written notice of our approval of the Manga
Pilot within 30 days after weve received it from you, then you can consider the Manga
Pilot rejected and the Exclusive Period will end right then and there, that is, on
expiration of that 30 day period."
Wait.. what's stopping you from changing my baby to something you like, and plastering your name on it?
your moral Ri-fuck.....
WHAT WE CAN DO WITH YOUR CREDIT
And, speaking of your credit, customarily we give you credit for your work as the writer and/or artist of the Manga Pilot. However, we may have to shorten or leave out your credit when the space available or the conventions of a format wont permit it or if it would have to be too small to read (for example, when the Manga Pilot is viewed on mobile phones). Youre OK with this.
WHAT?! then how hell is someone supposed to know that i did that?
you better make room~!
MATCHING OFFERS FROM OTHERS
If you and we cant agree on the terms or if weve agreed on terms but havent signed the Original Property Agreement by the end of the Exclusive Period, then well have the right to match any offer you receive from anyone else for any rights in the Project. That means that if you receive an offer that youd be willing to accept, youll have to tell us right away what the terms of that offer are, and well then have two weeks to decide whether we want to match that offer.
so we have to tell you if we get a better offer?and then you want to talk about it!
really??
you can't be serious, well it's guys straight from contract.
i kid you not, don't do it!
the worse thing is to me is that the website and company is geared toward a teen/younger teen group, who probably didn't read the contract and gave them their best work!
way to crush dreams Tokyo pop...next Del Rey (they look good)
